FED:No hunger strike says immigration

CANBERRA, Aug 6 AAP - The immigration department isn't aware that any of the asylum
seekers facing transfer to Malaysia have launched a hunger strike, as claimed by a refugee
activist.

A Department of Immigration and Citizenship spokesman on Saturday said no plan had
yet been announced for the asylum seekers' transfer to Malaysia.

"There is no one on hunger strike of which we are aware," he told AAP.

"Just because someone misses a meal or two does not mean they are on voluntary starvation.

"In any case, the department would urge any detainee engaging in voluntary starvation
to eat the food and drink the water that is available to them at all times.

"Any such action would not have an effect on their situation."

The first boatload of asylum seekers who are to be processed under the federal government's
swap deal between Canberra and Kuala Lumpur arrived on Christmas island on Thursday.

The group includes 18 minors, or people claiming to be minors. Up to 14 of them are
unaccompanied.

Refugee Action Coalition spokesman Ian Rintoul earlier said asylum seeker advocates
had received a distress call from one of the group on Friday.

"The short call said only: `We are in a bad way; we need help. We are starting a hunger
strike'," Mr Rintoul said on Friday.

"The abuse of their human rights has started even before they have been sent to Malaysia."

The immigration department spokesman said there was a lot of speculation about the
group's expected movement.

"They will be transferred as soon as practicable," he said.

Opposition frontbencher CHRISTOPHER PYNE says the sex scandal at the Defence academy
is the latest example of Defence Minister STEPHEN SMITH's inability to control his department.

Mr PYNE has told Sky News there's a standoff between the department and the actual
forces over the handling of the scandal .. with the minister reportedly asking military
chiefs to punish ADFA commandant Commodore BRUCE KAFER.

He says MR SMITH has to order a probe into the allegations of sexual harassment ..

bullying and bastardisation at the military college but must also make sure he doesn't
make particular individuals scapegoats.

Last week .. an 18-year-old female cadet at the academy in Canberra revealed she had
sex with another student while six others watched via video-link without her knowledge.

NT: Teenagers flee from man with gun

DARWIN, April 4 AAP - Northern Territory police are searching for a man last seen holding
a gun by a road in a rural part of Darwin.

Two youths approached the man shortly before 9pm (CST) on Saturday, after seeing him
sitting in a roadside drain.

But they fled when they saw he had a gun.

A NT police spokeswoman said the two youths, aged 16 and 17, thought the man might
be in need of help when they saw him sitting "randomly" beside Wells Creek Road, Virginia.

The teenagers said the man was dazed-looking and had pointed the gun at them when they
asked if he was alright, Duty Superintendent Bruce Porter told ABC radio.

Police have been searching the area, but so far without success.

The man is described as of caucasian appearance, average build, about 50 years old
with a large bushy beard.

He was wearing jeans and a fluorescent orange shirt with a silver reflective cross on the front.

Police have asked for anyone with information to contact Crime Stoppers on 1800 333 000.

BRISBANE, Aug 21 AAP - Three horse stud workers at risk of contracting the Hendra virus
have been transferred to a Brisbane hospital, where a veterinarian is fighting for his
life after testing positive to the potentially fatal infection.

Dr Alister Rodgers, a Rockhampton vet who treated a horse that died at the J4S equine
stud in Cawarral, has tested positive to the virus and is in a critical condition in the
Princess Alexandra (PA) Hospital.

Three stud workers, who also handled two horses that died from the Hendra virus on
the Cawarral property, have been admitted to the hospital for observation.

It is understood none of the three are exhibiting symptoms but have asked to be monitored
as a precaution.

All four underwent five days of anti-viral treatment, with Ribavirin, in Rockhampton
hospital, which finished this week.

Dr Rodgers' wife Linda and children, Courtney and Duncan, said in a statement they
were distressed about claims that he should not have been released from Rockhampton hospital.

"Alister showed no symptoms that are distinctive of Hendra virus when he was discharged,
although he understandably remained anxious as anyone would in such situation," the statement
said.

They said that based on a previous pathology test and no physical signs, he was thought
to be safe and the doctors and nurses who cared for him at the hospital should not be
condemned for discharging him.

A Brisbane veterinary nurse who survived the Hendra virus last year says her thoughts
are with Dr Rodgers and his family.

"I hope the Ribavirin has slowed down the virus," Natalie Boehm said.

"And I hope the others don't get it. They must remember there's a slim chance. I was
one of two out of 30 people who came into contact with horses with the virus."

Ms Boehm's colleague, vet Ben Cunneen, died during the Redlands Veterinary Clinic outbreak
a year ago.

Three of the seven people who have had Hendra have died.

Australian Veterinary Association president Mark Lawrie said vets across Australia
were very anxious for Dr Rodgers and his family.

"We've learned a lot about the virus in the 12 months since the tragic death of Ben
Cunneen," Dr Lawrie said.

"It's a terrible shock for the whole profession to have this happen again."

Veterinary surgeon Dr Nigel Perkins, who reviewed a response to an outbreak last year,
said the virus was now endemic in Australia, but remained uncommon.

He said a pattern had emerged and it could be expected a small number of horses would
be stricken with the disease each year.

He said it was up to everyone who interacts with horses to improve the way they handle
the animals.

"Washing hands, washing clothes, washing items of equipment, trying not to transfer
mucus - it's simple hygiene," he said.

Dr Lawrie said vets in Queensland were taking the risk of Hendra virus very seriously.

Further test results on horses at the Cawarral stud are expected to be known by Saturday.

The World Health Organisation report estimates accidents send 66 thousand Australian
children to hospital each year .. costing the community billions of dollars.

causes of unintentional injury.

NSW: Court application could kill tax case against Paul Hogan

SYDNEY, Dec 8 AAP - If Paul Hogan is successful in getting rid of the team currently
investigating his alleged tax evasion the entire probe could be abandoned, the Federal
Court has been told.

The Australian Crime Commission (ACC) is planning to continue its five-year probe into
claims the Crocodile Dundee star channelled millions of dollars into offshore tax havens.

But Hogan's lawyers have applied for anyone who has viewed any of 35 seized documents
to be excluded from taking part in further investigations.

Justice Arthur Emmett has been told the documents were seized from accountants Ernst
& Young in late 2005 and returned by the ACC two months ago.

The ACC determined in March 2006 that the documents were not relevant to its investigation,
but held onto them until recently, Hogan's lawyers have said.

In Sydney on Monday, the ACC's Ian Andrew, who heads up the investigation into Hogan's
affairs, said that without the expertise of his team the investigation might not be able
to continue.

"It would difficult to replace us ... and without a very lengthy briefing, it would
impossible to transmit our collective knowledge to the new investigative team, if one
could be put together," Mr Andrew told the court.

"There could well be people ... who could be seconded, who have similar qualifications,
experience, and inclination but not the collective knowledge.

"In my view I think the ACC would have to consider the merits of continuing the investigation
(given the time and money it would take) bringing new investigators' standards of knowledge
up to what exists today."

The hearing continues.

Oxfam Australia has been cautioned by the consumer watchdog after a complaint was made
about its promotion of Fairtrade certified brands.

Free market think tank .. the Institute of Public Affairs .. complained to the ACCC
saying Oxfam's been misleading consumers about the brands helping farmers in developing
nations.

The institute says numerous studies show fair trade is NOT helping lift people out
of poverty .. as claimed by Oxfam.

Oxfam has been told repeating claims made by Fairtrade left it at risk of contravening
the Trade Practices Act.

A Labor frontbencher says the wording of the apology to the stolen generations will
be released tomorrow.

ANTHONY ALBANESE .. who's manager of government business in the House of Representatives
.. says they're close to finalising it.

And he's told ABC radio everyone will get to see it when the government gives formal
notice of the motion tomorrow.

Prime Minister KEVIN RUDD will deliver the apology in parliament on Wednesday .. with
more than 100 members of the stolen generations looking on.





The government's ruled out compensation for indigenous Australians who were taken from
their families .. as recommended in the 1997 Bringing Them Home report.

MICHAEL LAVARCH .. the former Labor attorney-general who established the initial stolen
generations inquiry that led to the 1997 report .. has told ABC radio he'd like the RUDD
government to reconsider its position.

Convicted murderer SEF GONZALES' lawyer says his client was misled by police into thinking
he was not a suspect .. and asked to make inappropriate assertions about witnesses at
his trial.

The 26-year-old is challenging his conviction and three life sentences for the murder
of his parents and teenaged sister .. at their north-western Sydney home in July 2001.

He's launched an appeal on nine grounds relating to admissibility of evidence and conduct
of the prosecution at his Supreme Court trial.

His lawyer .. PAUL BYRNE SC .. told the NSW Court of Criminal Appeal police repeatedly
assured GONZALES he was not a suspect in the murders .. when this was clearly not the
case.

MR BYRNE said this made the admission and use of subsequent evidence he gave to police unfair.

He also said calling evidence about GONZALES' inquiries and purchases following the
deaths as proof of a motive .. was unduly prejudicial.

GONZALES also strongly objected to the manner in which he was cross-examined by the
crown prosecutor MARK TEDESCHI QC .. and his description of his evidence as 'absolutely
pathetic'.

Mr BYRNE said it was completely inappropriate that Mr TEDESCHI repeatedly told GONZALES
.. five witnesses who gave evidence to contradict his story were wrong.

He said essentially Mr TEDESCHI was saying GONZALES was either guilty .. or the unluckiest
person alive.

Mr BYRNE also said Mr TEDESCHI's closing address which started with the words .. 'Where
do I start .. there's such an overwhelming case against the accused' .. was also unjust.

The hearing continues.

SYDNEY, April 9 AAP - Police have renewed their call for a hit-and-run driver to come
forward, after a young victim spent his 10th birthday in hospital with a broken jaw.

The boy, named only as Nethaniel, was sitting on a kerb in North Balgowlah, on Sydney's
northern beaches, at 5.20pm (AEST) on March 31 when he was struck by a dark-coloured utility
with a male driver.

The vehicle failed to stop and Nethaniel was rushed to hospital suffering fractures
to his hands and jaw.

Police appealed today for the driver of the vehicle to come forward, saying it was
possible he did not realise he had been involved in a crash.

Fed: Abbott says he thinks abortion pill vote will pass house

SYDNEY, Feb 10 AAP - Federal Health Minister Tony Abbott said he expects a bill stripping
him of his powers over the abortion drug RU486 will pass the House of Representatives.

After two days of personal stories and a rare conscience vote, senators yesterday supported
a private members' bill - 45 to 28 - transferring the minister's powers to experts at
the Therapeutic Goods Administration (TGA).

Now for the bill to become law - overturning an effective ban on RU486 - it must be
passed by the House of Representatives.

"I certainly think that there is every chance the private members bill will be approved
in the House of Representatives," Mr Abbott today told reporters in Sydney.

"I will counsel my House of Representatives colleagues to think long and hard before
they follow the example of the senate."

LONDON — Auction site eBay says a bidder has offered $120,000 for the spiraling headpiece worn by Princess Beatrice to last month's royal wedding.

The 22-year-old granddaughter of Queen Elizabeth II startled commentators with the swirling hat she wore to the wedding of her cousin Prince William and Kate Middleton.

The silk Philip Treacy creation, which has been compared to antlers, a toilet seat and a pretzel, as been put into scores of unlikely scenarios in photos manipulated for the Internet.

Beatrice has taken the joke in stride and put the hat on sale for charity. Proceeds will go to UNICEF and Children in Crisis.

On Saturday, 38 bidders were competing for the hat, described on eBay as a "unique sculptural celebratory headpiece."

A new report from the Health & Safety Commission (HSC) calls for a programme of targeted action to reduce the likelihood of accidents caused by vehicles getting on to railway lines.

The report was prepared by a Working Group established by HSC, at the request of the Deputy Prime Minister, to look into the problem of vehicles obstructing railway lines following the incident at Great Heck, near Selby, last February in which 10 people died.

Having examined the low probability of this type of accident and the steps that can be taken to mitigate the risks, the Working Group sets out an agenda for targeted action. Their report makes seven recommendations, which include: - taking forward current initiatives to develop a comprehensive risk assessment tool to make it possible to assess, on a consistent basis, the risks at locations where railways and roads intersect or run close to each other; - thorough risk assessment of all locations, a quick 'first pass' to filter out lower risk locations, comprehensive assessment of the remainder and action completed, where needed within two years at latest; and - development of a protocol to ensure no misunderstandings arise as to the responsibilities of the respective road/rail authorities.

Introducing the report, Richard Clifton, head of the Health & Safety Executive's (HSE's) Railways Directorate and chairman of the Working Group, said: "Although the report emphasises how rare the sequence of events behind the Great Heck accident were, its consequences demand that a more systematic programme of action be taken to further reduce the risk of a similar accident occurring.

"The Working Group looked at the hazards associated with vehicles obstructing railway lines and concluded that the risk, although small in relation to other road and railway risks, is higher at some locations than others. As there are thousands of sites where roads cross or run alongside railways, it is important to adopt a targeted approach, which is proportionate to the risk levels at each site.

"Drawing on initiatives already in place, we propose a series of 'first pass' risk assessments, within the year, to filter out lower risk locations and identify those sites where further safety measures are deemed necessary. This could entail anything from changing road markings to erecting new safety barriers. Action at those sites identified as higher risk should be completed within two years at the latest.

"We also propose that the Department for Transport, Local Government and the Regions (DTLR) should lead on establishing a protocol to ensure no misunderstandings or difficulties occur concerning the respective responsibilities of road and rail authorities. This should not be allowed to delay any prospective work." Endorsing the report, HSC Chair Bill Callaghan said: "On behalf of the Commission I would like to extend our deepest sympathies to the families of those who were killed and those injured at Great Heck.

The report recognises the low probability of significant railway accidents caused by vehicles getting onto railway lines. At the same time it is clear that the random nature of such a chance occurrence does not allow for any complacency." It is more than a decade since the dotcom bubble burst but one lawyer in particular remembers it as if it were yesterday.

"I've been interested in the internet since 1995 when there was no work to speak of," recalls Lecote founder Andrew Sparrow. "By 2000 when the bubble burst I'd already been working in the sector for several years."

Sparrow, then a partner at Birmingham firm Lee Crowder (now part of Cobbetts), says that in a way the bubble bursting was a good thing.

"A lot of law firms came to the sector late and thought it wasn't viable," he says. "But I was so committed that I decided to set up a new firm."

So Lecote was born in 2002, with the aim of handling legal work associated with the internet. The firm now acts for a range of new media clients including online games developers, website designers, software developers and television and film production companies on web- related issues.

"It's not an easy business climate but a lot of spend is going online," says Sparrow. "It's very dynamic."

He points to the success of social networking businesses as evidence that early doubters of the web's importance were wrong, saying that few saw how successful it was going to be.

The lawyer is convinced that one of his firm's recent innovations will also be a success. Last year Lecote delivered a so-called 'virtual world' for an event attended by a range of clients and other professionals. The firm built a virtual auditorium in Second Life and guests around the world attended via their avatars. The objective was to show how the virtual world can be a viable platform for legal services.

"This technology will be much more widespread in future and lawyers will be part of it," says Sparrow. "A few years ago nobody thought about Facebook - you can't rule anything out with the internet."

VA Appoints Under Secretary for Memorial Affairs.

Steve Muro, a Vietnam Veteran with leadership experience at every level within the Department of Veterans Affairs National Cemetery Administration, has been sworn in as Under Secretary for Memorial Affairs.

According to a release, Muro has been the Acting Under Secretary for Memorial Affairs since January 2009.

"Working with Steve Muro for more than two years, I know he has the vision to help transform the Department of Veterans Affairs," said Secretary of Veterans Affairs Eric Shinseki.

"Together with the other men and women of our Cemetery Administration, he will continue working to serve those who sacrificed for our country, their families and survivors."

As the senior official for VA's burial operations and memorial affairs, Muro is responsible for overseeing 131 national cemeteries that provide burial services for military Veterans and eligible family members. He is responsible for operating and maintaining VA cemeteries as national shrines and for land acquisition and other activities related to establishing additional national cemeteries. His responsibility also includes programs that provide headstones, grave markers, medallions and Presidential Memorial Certificates for eligible Veterans, as well as federal grants to help U.S. states, territories and tribal governments establish Veterans' cemeteries.

Previously Muro was the director of the cemetery administration's Office of Field Programs and Deputy Under Secretary for Memorial Affairs. He was named Acting Under Secretary for Memorial Affairs on Jan. 21, 2009.

The VA operates 131 national cemeteries in 39 states and Puerto Rico and 33 soldiers' lots and monument sites. More than 3.5 million Americans, including Veterans of every war and conflict, are buried in VA's national cemeteries on more than 19,000 acres of land.

Veterans with a discharge issued under conditions other than dishonorable, their spouses and eligible dependent children can be buried in a VA national cemetery. Also eligible are military personnel who die on active duty, their spouses and eligible dependents. Other burial benefits available for Veterans, regardless of whether they are buried in a national cemetery or a private cemetery, include a burial flag, a Presidential Memorial Certificate and a government headstone or marker. Families of eligible decedents may also order a memorial headstone or marker when remains are not available for interment.

CIA RELEASES BIN LADEN VIDEOS, SAYS HE WAS ACTIVE TERRORIST COMMANDER.

The U.S. Central Intelligence Agency says the compound in Pakistan where Osama bin Laden was killed by American commandos on Monday was an active command and control center for al-Qaida, and that bin Laden was not just a strategic or inspirational leader for the terrorist group. A senior intelligence official made the comments at a briefing at the Pentagon Saturday, during which he also released five video clips of bin Laden that were captured during the raid.

The official, who spoke on condition of anonymity, says the material gathered by the assault team amounts to the largest trove of information ever captured from a senior terrorist leader. He says there is so much material that officials are still cataloguing it.

The official says the material is already providing what he called "some golden nuggets" of information and "important insights" into al-Qaida's operations. He would not provide specifics, but he said the information indicates that bin Laden was involved in generating ideas for terrorist attacks on the United States and around the world, provided tactical and operational guidance, and directed daily operations. He says bin Laden was not only a figurehead or strategist, as some people had thought.

In a written statement, the CIA director, Leon Panetta, said that "further confirms how important it was to go after bin Laden."

The official who spoke on condition of anonymity said bin Laden continued to have a particular interest in attacks on transportation facilities and other types of infrastructure, the type of targets al-Qaida has hit in the past. He says bin Laden managed to run his organization through couriers, like the one who unwittingly led U.S. investigators to the compound, which had no telephone or Internet service.

One of the released video files, apparently shot during an unguarded moment, shows a gray-bearded bin Laden watching television. He is wearing a black knitted cap and has a brown blanket over his shoulders. He gestures to the camera operator to focus on the television, where he is selecting various channels that are broadcasting some news about himself. The CIA deleted the audio from the video clips.

Another clip is a message to the United States, which the intelligence official says includes familiar criticism of U.S. policy and the capitalist economic system. In that clip, the beard is black, indicating, the official says, that bin Laden had dyed it to maintain his public image. The official says bin Laden's beard was gray when he was killed. The official says that video was recorded late last year, but there are no dates on the other excerpts. The three other clips show rehearsals or outtakes from video messages.

The senior U.S. intelligence official says the team also took digital and paper copies of personal correspondence to and from bin Laden. He said such videos and documents would not likely be in the possession of anyone other than bin Laden himself.

The official also provided some details about the formal identification of bin Laden's body after he was killed by the commandos. He says sophisticated facial recognition software provided a 95-percent match from photos of bin Laden. And he reported that two separate analyses of DNA from the body matched the genetic profile gathered from several known bin Laden family members, with what he called only a one in 11.8 quadrillion chance of error. In the American system, a quadrillion is a million billion.

The official says a U.S. government team will take some time to go through all the material, looking particularly for information about al-Qaida members, plans and finances. In addition, he says the team is looking for links to other terrorist groups around the world and any information about possible efforts to acquire weapons of mass destruction. He says some of the information is being shared with other countries, but he would not say which ones.

The official also said the CIA believes it is significant that in acknowledging bin Laden's death, al-Qaida did not name a successor. He says that would appear to add credibility to the view that the number-two al-Qaida leader, Ayman Zawahiri, is not popular with all segments of the movement. The American intelligence official described Zawahiri as a controlling, micro-manager who is not charismatic, like bin Laden was.

The official called the nearly 10-year effort to find bin Laden perhaps "the greatest intelligence success..of a generation." He said it was based on years of relentless, precision work on the U.S. intelligence community's top priority.
